These fraudulent communications may come through email or phone.
If your customers ask you about this, please share the following message and IRS article with them. To protect yourself, avoid sharing personal information with unsolicited contacts and always verify claims directly with the IRS. Leaving Tax Advice to the Professionals
Recently, FlaSEIA has become aware of a small number of CPAs proposing esoteric tax structures to potential Florida customers to realize more tax savings from provisions in the Inflation Reduction Act. FlaSEIA finds these proposals to be out of the mainstream, potentially misguided, and not recommended for any FlaSEIA member contractor to discuss with a potential customer.
While we understand a contractor’s desire to present the most financially appealing solar proposal to potential customers, we recommend steering clear of offering tax advice beyond a straightforward description of the mainstream incentives available. If a homeowner, for example, wants to take third-party CPA advice to monetize their solar system through production tax credits intended for commercial systems, that is a homeowner’s independent decision and should not be part of the contractor’s proposal. Any such ideas likely require an IRS private letter ruling before even being considered as seriously viable.
It is important to remember that providing incorrect tax information can lead to potential civil and even criminal penalties. These penalties may be applicable, even if a contractor simply reiterates the false information received from a third-party CPA.
FlaSEIA takes consumer protection very seriously and wants to see ethical transactions, which provide customers tangible, reliable value for their solar systems.
